Will your lawyer take the tough injury case?
Over my years of practicing personal injury law in the Virginia Beach and Norfolk, Virginia (VA) area, one of the things I have most enjoyed is successfully getting compensation for someone injured in a case that was turned down by other lawyers who saw the case as too difficult to take on. For example, I recently settled a case where my client rear ended another driver and was severely injured. Most lawyers would have looked at that case and said if the potential client hit the rear end of another vehicle that there was no way that they would pursue that case, especially in a state like Virginia (VA) that has
contributory negligence. However, because of the severe injuries to my client, I went ahead and dug deeper into the case to try to show that although my client, a trucker, hit something stopped in the road ahead of him, it wasn’t really his fault. I was able to secure a strong
mediated settlement in the hundreds of thousands of dollars for the client.
My law partners also take on tough accident cases that other lawyers would probably not mess with, because it wasn’t a slam dunk. For example, my law partner Jim Lewis recently helped a man who got hurt outside of a fast food restaurant when he stepped into a hole in their parking lot. The case had already been turned down by some other attorney before the man called our firm. Because the client had a real injury involving surgery, Jim pursued it for him and got a decent result of tens of thousands of dollars for the client.
My law partner Rick Shapiro loves to tell a story how he took a medical malpractice case which involved in a gastric bypass surgery gone wrong. The case was against a doctor from North Carolina (NC). In filing suit in Elizabeth City, North Carolina (NC), Rick tried to get one of the main personal injury lawyers in that town to assist him on the case. The North Carolina (NC) law firm declined because they didn’t want to ruin their reputation with the federal judge down there by taking a case that they didn’t think was meritorious. As it turned out Rick obtained half a million dollars on the case. He made sure to let the attorney who wouldn’t even assist as local counsel with it in North Carolina (NC) know that they had made a mistake.
Our law firm keeps track of the tough injury cases we have won on our website. The main satisfaction in handling difficult cases to a good result is the appreciation of the client that our law firm was willing to go the extra mile and really work hard to get the best outcome possible when others wouldn’t listen. We also get a certain pleasure from knowing that we earned a big fee for our law firm on an accident case that some other lawyer could have had if only they had been willing help an injured person when the recovery wasn’t clear or easy.
