RESULTS: $300,000 Full Policy Settlement

WHAT HAPPENED:
In this Hampton personal injury case, our client was stopped at a light on Mercury Blvd. in Hampton, Virginia. The defendant, who was not paying attention, struck the rear of our client’s vehicle. Our client received medical treatment for injuries to his neck and back. One of his treatments was a neck fusion surgery. Unfortunately, our client’s incision became infected after the surgery, requiring additional care and treatment. The insurance carrier adjuster for the at-fault defendant initially indicated that our client’s injuries were not consistent with the impact of the collision.
LEGAL STRATEGY:
In all cases handled by our firm, we strive to recover all allowable compensation for our clients. While the insurance adjuster indicated that the infection (and subsequent treatment) was not due to the accident, we claimed that all of the medical treatment, including treatment from unforeseen complications of treatment related to the accident, was compensable and, therefore, must be paid to our client.

After initial pushback, the insurance company agreed that our client was entitled to full compensation, including those injuries related to the infection. The company agreed to pay the full policy limits to resolve the case.
